We are rallying together before the trial of Rodney Loper, Bo & Luke’s former owner. This man is accused of leaving these dogs without food or water for 4+ weeks. He is currently being charged with second degree animal cruelty, a misdemeanor in the state of Alabama. During his arraignment in May of 2011, Mr. Loper pleaded “not guilty”.

Since the passing of Gucci’s Law (Pet Protection Act) in 2000, charges of animal cruelty can warrant a felony charge if the person “intentionally tortures any dog or cat”. More details at the bottom of this post.

Mark Erwin – the judge for this case (251.675.5393) & the prosecutor, Jeffrey Perloff (251.478.6899) between now and Monday, December 12th and *politely* requesting that they try Mr. Loper under a FELONY CHARGE for INTENTIONAL TORTURE/ANIMAL CRUELTY. Encourage them to administer the most severe sentence allowed by law and send a clear message to their constituents that Saraland takes animal cruelty very seriously.

More information on Alabama’s Animal Cruelty Statutes:
Title 13A. Criminal Code. Chapter 11. Offenses Against Order and Safety. Article 1. Offenses Against Public Order and Decency.

§ 13A-11-14. Cruelty to Animals.
(a) A person commits the crime of cruelty to animals if, except as otherwise authorized by law, he intentionally or recklessly:
(1) Subjects any animal to cruel mistreatment; or
(2) Subjects any animal in his custody to cruel neglect; or
(3) Kills or injures without good cause any animal belonging to another.
(b) Cruelty to animals is a Class B misdemeanor.
(Acts 1977, No. 607, p. 812, § 5565.)

§ 13A-11-240. Definitions.
(a) The word “torture” as used in this article shall mean the act of doing physical injury to a dog or cat by the infliction of inhumane treatment or gross physical abuse meant to cause said animal intensive or prolonged pain or serious physical injury, or thereby causing death due to said act.
(b) The word “cruel” as used in this article shall mean: Every act, omission, or neglect, including abandonment, where unnecessary or unjustifiable pain or suffering, including abandonment, is caused or where unnecessary pain or suffering is allowed to continue.
(c) The words “dog or cat” as used in this article shall mean any domesticated member of the dog or cat family.
(Act 2000-615, p. 1252, § 1.)

§ 13A-11-241. Cruelty in first and second degrees.
(a) A person commits the crime of cruelty to a dog or cat in the first degree if he or she intentionally tortures any dog or cat or skins a domestic dog or cat or offers for sale or exchange or offers to buy or exchange the fur, hide, or pelt of a domestic dog or cat. Cruelty to a dog or cat in the first degree is a Class C felony. A conviction for a felony pursuant to this section shall not be considered a felony for purposes of the Habitual Felony Offender Act, Section 13A-5-9 to 13A-5-10.1, inclusive.
(b) A person commits the crime of cruelty to a dog or cat in the second degree if he or she, in a cruel manner, overloads, overdrives, deprives of necessary sustenance or shelter, unnecessarily or cruelly beats, injuries, mutilates, or causes the same to be done. Cruelty to a dog or cat in the second degree is a Class A misdemeanor.

    There is no excuse for torturing and/or leaving an animal to die. The person who would do such a thing should find out what torture, starvation, and abandonment feels like in real life. Somehow we need to find a way to make sure that all companion animals are spayed & neutered so that no more unwanted animals are left to die, be tortured, and/ or starve to death. There are so many animal lovers out there that would do anything in their power to save all of the unwanted, unloved animals. Unfortunately, there are just too many, & people are just too IGNORANT. Maybe we need to start educating the PEOPLE…………. WHY should the innocent animals suffer???????????????////

    Dogs are social beings and as such, love & trust their human companions to care for them. It is despicable that some humans care not for their animal companions. If a person will abuse, neglect or harm in any way, an animal, a person will do this to another person.

    Please speak for those that cannot speak for themselves. Dogs are like children and need to be loved and cared for like children.

    you need to request that the original charges be amended to the felony count. the way this reads it is indeed a felony, unless they’re caught up on the “intent” part. if he abandoned them for four weeks, that’s clear intent to me.

    A horrible story. Sadly, this type of crime is seen all over. I am not close appear in person, but I will call the numbers listed above. Perhaps justice can prevail and they could start by making an example with Rodney Loper to “send a message”. It is way past time action is taken and with more serious punishment. Obviously, small fine amounts and a few hours of community service just isn’t doing it!

    From the articles I have read and the photos I have seen it is certain that Rodney Lyman Loper purposely tortured the innocent animals involved in this horrible this case. Mr. Loper knew exactly what he was doing the day he drove away, from his rental property, leaving Bo trapped inside a cage and Luke tied to tree. By leaving these dogs without food, water, and shelter proves that Mr. Loper premeditated his actions. He knew these dogs would certainly die without proper care. Mr. Loper not only had days to save these starving dogs he had weeks! Mr. Loper’s actions prove that he tortured these animals by abandoning them.

    According to the Alabama’s Animal Cruelty Statutes Mr. Loper is guilty of being cruel to a domestic animal. Even more so, Mr. Loper is guilty of willfully torturing a domestic animal with the intent to kill it.

    Please sentence Mr. Loper the highest degree for purposely torturing, not just a domestic animal, but for torturing man’s best friend.

    I am at a loss for words. My heart aches for these two precious babies. I rescued a Rat Terrier from similar circumstances and feel that the punishment for animal cruelty needs to be more harsh! It breaks my heart to see any animal suffer in the hands of these monsters that call themselves human beings! Throw the owner’s ass in prison and starve him just as long, don’t give him a bed to sleep on, no covers and release his ass to the “big dog” so he can make him his bitch!! Nuff said!

    This should be a felony. This person was responsible for the care of these animals and he intentionally left them with no food or water. Perhaps his punishment should be that he will have to go without food or water for a period of four weeks. I would be willing to be he wouldn’t last as long as the dogs. Dogs deserve to be treated with kindness and respect, two thing this peson knows nothing of. He should not be allowed to ever own animals again.

    My husband,Eaton Barnard, just talked to Jeff Perloff about the abuse case involving the dogs and this is what he told me:

    “I just spoke to Jeff about this case. We were interrupted 3 times by people calling about the abuse case. As you and I discussed, Jeff confirmed that the magistrate is the person who makes the call on whether or not the case amounted to a felony. Suffice it to say, they ( magistrate and /or District Attorney) made the decision that the facts of this case did not suffice to warrant a felony charge. There is no way to prove that the Defendant “intended” to cause the dogs harm. However, Jeff assured me that he has already told the Defendant’s attorney that there will be no deals on the misdemeanor criminal charges and he will ask for a maximum fine AND jail time (up to one year).

    Jeff asked me to tell you to post something on FB telling people that Jeff intends to convict the guy and will push for jail time. However, he cannot prepare for trial with everyone calling him. There is no need for any further phone calls to Jeff , he intends to do everything he can.”~Eaton G. Barnard

    Rodney Loper should have the same treatment invoked on him!!!! He is a disgrace!!!!! Hopefully everyone is calling the prosecutor and petitioning he get a felony charge and maximum sentence!!!!     This is absolutely heartbreaking! I Thank God that Bo and Luke were found before it was to late for them, but I think about all of the other poor furbabies out in this world who have not and are not as blessed as Bo and Luke were to have been found! Two wrongs do not make a right, and I believe if these two precious furbabies could talk they wouldn’t want this monster of a man to suffer as they had been made to! That is why they are called “MAN’S BEST FRIEND”, but he should be made to pay in some way for his cruelty! My heart hurts for these babies and all the other poor furbabies of this world who are being made to suffer this way by such heartless individuals! Praying that Gods will be done in this situation and he get’s what he deserves!
